Thank you for using vote4me.com.au. By engaging with and using the Service you agree ('we' or 'us') to be bound by and abide by the following terms and conditions. In this document the service the Service refers to a premium SMS service owned by BJD HIRE. The Words 'client', 'you', 'them', &'customers' and 'they' are references to any person who sends a text into the Service. These terms and conditions may be changed by us at any time without prior notice to you. With continued use of the Service you are expected to view the most current Terms and Conditions.
1. The Service comprises of texting, i.e. Retail and the venue name and your opinion of the service (good or bad) Via SMS to 199 44 888 to vote4me.com.au ('the Service') vote4me.com.au (SMS costs $0.55c per msg sent).
2.1 Only persons or venues/retail stores that can be clearly identified should be voted for. Any person's names or persons voting for each other by name will be counted as a dummy votes and used to reward good staff. Voting should take place as follows.
- For bar or nightclub, text (bar) the venue name and your opinion.
- For cafe, text (cafe), the venue name and your opinion.
- For a Hairdresser text (Hair), the salon name and your opinion.
- For security guard, text (guard), his/her ID number, the venue name and your opinion.
- For taxi driver, text (taxi), the drivers ID number and your opinion.
- For a restaurant, text (rest), the venue name and your opinion.
- For Retail, text (Retail), the store’s name and your opinion.
- Text your MSG to 199 44 888
(costs $0.55c inc gst per msg sent).
2.3 vote4me.com.au will not be held responsible or accountable for any unreadable or non-identifiable msg's. Any unreadable or unidentifiable text msg's will be counted as dummy vote's.
2.4 Persons or venues stores rewarded by vote4me.com.au will have the opportunity to have their name and photo (optional) posted on the Winners page, of the web site vote4me.com.au in recognition of their good service.
2.5 When you SMS to the Service you will receive a free reply SMS with Thank you for voting rewarding good customer service. You have been entered in the prizes and parties draw. However, the Service is not whole proof and from time to time messages are not received.
2.6 All information collected by the service vote4me.com.au will be held private confidential unless requested the person or venue in question. Only the best venues and staff with their votes, will be posted on the Winners page web site vote4me.com.au
2.7 The voting cycle takes place over two a month period staring at midnight on the 1st of December at 12:00am and ending at 11:59pm on the 31st January. And will continue as follows:
Start 1st February at 12:00am to March 31st 11:59pm.
Start 1st April 12:00am to May 31st 11:59pm.
Start 1st June 12:00am to July 31st 11:59pm
Start 1st August 12:00am to September 30th 11:59pm
Start 1st October 12:00am to November 30th 11:59.
End of 12months voting.
The persons and venues rewarded by vote4me will be posted on the web site once identified and located.
2.8 This service is restricted to persons 18 years and older only. The Service will not be held accountable for any persons aged 15 and under messaging into the service. This is the responsibility of their parents/guardians. All marketing tools/promotional give aways will clearly state this. All users must have the phone holders permission before using the Service.
2a.1 The service is not a subscription service. Each SMS sent to the service costs $0.55 (G.S.T inclusive). The message sent back to your phone costs $0. By sending a SMS to the service you agree to and consent to these terms and conditions and accept the cost deducted from your phone bill. By using the service you are also consenting that you have the bill payers permission to do so.
2a.2 All personal detail, photos, and listings made by any business and posted on vote4me, become the property of vote4me/BJD Hire. And we reserve the right to remove, use as advertising, or not allow any listing we deem unfit, for viewing on the web site vote4me.com.au
3. Indemnification
3.1 You agree to indemnify and hold its parent, subsidiaries, affiliates, officers, agents, directors, contractors, licensors and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of or in connection with (a) your use of the Service, and (b) the breach by you of your representations and warranties set forth herein.
3.2 The Service contractors and associated partners of the Service will not be held liable for actions resulting from answers received from ('the Service').
3.3 We own, or have obtained a licence from a third party to use, all intellectual property rights in the operation of the Service including without limitation, copyright in the messages provided by you, rights in the list of questions and answers we maintain and rights in all of the technology used to compile and coordinate answers and our logos and trademarks.
4. Privacy Statement
4.1 The Service respects the privacy of its customers. If you specifically and knowingly provide any personal information via the Service, you consent to us lawfully using that information (E.g. to provide promotional or other information to you). For information about our collection and use of information in connection with the Service, please read our Privacy Statement (attached).
4.2 The Service reserves the right to store all mobile numbers received. The Service may then use these numbers to do send-outs; promoting the Service or any changes to the service. The Service will not charge the customer for any messages sent to their phone.
4.3 The Service may be used for corporate marketing. This means You may receive free messages from time to time advertising a product/service from a corporate organisation other than Vote4me.com.au
7. Liability
7.1 If you use the Service, some legislation may imply certain non-excludable terms, conditions or warranties into the contract between us, or may give you certain non-excludable remedies against us (Statutory Rights). If we breach a non-excludable term, condition or warranty, then our liability for that breach will be limited to supplying the Service again or the payment of the cost of having the Service supplied again.
7.2 Except as expressly provided in these terms and conditions, or as required by law (including under your Statutory Rights), we exclude all warranties, undertakings, conditions, terms and obligations, of any kind (including warranties as to merchantability or fitness for a particular purpose), whether express or implied, relating in any way to the Service.
7.3 Without limiting the previous paragraph and except as required by law (including under your Statutory Rights), we will not be liable (including in negligence) for: (i) any loss of profits, loss of revenue, or any direct, indirect or consequential loss or damage, incurred by or awarded against you or any other person arising directly or indirectly from your use of the Service; or (ii) any cost, loss, liability or expense arising from death, personal injury or damage to property resulting directly or indirectly from your use of the Service.
7.4 The Service will not be held liable for any injury, death or damage of as a result of misusing a promotional.
9. Amendment
9.1 The Service reserves the right to amend these Terms and Conditions and our Privacy Policy at any time without notice to you. Your continued use of this Service after any such changes constitutes your acceptance of the new Terms and Conditions. We will make reasonable efforts to bring any changes to the attention of our users, but you should also check this page regularly to familiarise yourself with any updates.
11. Governing law
11.1 The laws of the State of Victoria, Australia govern these terms and conditions, and you irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of Victoria, Australia to resolve any dispute that arises as a result of or in connection with this agreement.
11.2 These Terms and Conditions are to be interpreted so that they comply with all applicable Victorian laws and if any provision does not comply then it must be read down so as to give it as much effect as possible, however if it is not possible to give that provision any effect at all then it is to be severed from this agreement in which case the remainder of this agreement will continue to have full force and effect.
11.3 These Terms and Conditions are the entire agreement between the parties as to their subject matter and supersede all prior or inconsistent statements or representations as to that subject matter.
